Will I have to file for divorce again after a certain period if my husband refused to sign my first filing in 2008?

Yes, if you do not finalize that case before it is dismissed for lack of prosecution. At some point, the court will schedule the case for a peremptory calendar that deals with old cases that are not being pursued. If the case is not being moved forward, then the court will dismiss?it, and you would have to refile it. You can avoid it being dismissed by just scheduling it for a hearing to finalize the case.

Is there any way I can get a divorce court order withdrawn or changed?

Answered by attorney Patricia A. Kasody-Coyle
Divorce lawyer at Jackman & Kasody, PLLC
The only way to change the terms of your JOD regarding what you owe your ex is if your ex is willing to consent to a modification of those terms, otherwise you owe the money and he could file a motion to enforce the judgment. This response is general in nature and is not legal advice.  No attorney client relationship is formed by it.

How can I guarantee that we have 50/50 custody? Who gets the apartment if my name is on the lease but she pays the rent?

You can't guarantee it. All you can do is show the court why you should have equal custody. You might almost be able to make the claim that you should have primary custody since she is working and you have been the primary care giver. Talk with your attorney about it.
