If my husband is in prison, what is the easiest way to divorce him?

Answered by attorney Patrick "Leh" Meriwether
Divorce lawyer at Meriwether Tharp, LLC
If the children are from another relationship and you have little property with your husband, then the divorce should be relatively simple. I would reach out to a local attorney to see if they can help you with a hopefully uncontested divorce.

Can I get a divorce? Can I get spousal support and child support for our kids after the divorce?

Of course you are entitled to child support for the children, so long as he is the father. Spousal support in Idaho is a little more dicey. If you are working, probably not. If you have a degree probably not. However, each situation is different and your attorney will be best able to get you what you deserve from the guy who doesn't understand what the term "vow" means.

How do I get my ex husband’s SS number so I can file for my portion of his retirement?

J Matthew Catchick

If he is already in "in-pay" status, that could adversely affect your rights to his plan. Time is of the essence in your situation, so first request his address from the Secretary of State, and then file and serve him with a post-Judgment Motion seeking entry of a QDRO, and requiring him to disclose his social security number.
