How do I go about divorcing my husband that is in the prison for sexual assault to a child?

Laura J Gabel
Answered by attorney Laura J Gabel (Unclaimed Profile)
Divorce lawyer at Gabel, Gudmundsen & Gabel, P.C.
You can file for divorce just like you would any other divorce. When it comes to serving him with the papers, though, you have to go through the warden's office. I would suggest that you confer with a qualified divorce attorney, especially if you have children with him.

Will a judge grant my divorce?

Answered by attorney John R Ceci (Unclaimed Profile)
Divorce lawyer at John Ceci PLLC
In Michigan it doesn't matter if one party to a divorce does not agree to the divorce. If one party wants the divorce then it will happen. I have never handled a divorce with the other party being in jail. He has the right to received documents and to participate if he chooses. You should consider retaining an attorney to make sure you handle the process correctly.

No, your husband contributed to the pregnancy and has responsibility for it. Ask the court to order him to pay half of the bills.
