I am getting a divorce and my husband’s attorney's law firm represented my brother and cousin in the past, isn't that a conflict of interest?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
It might be, but since they did not represent you, it is not as clear cut. Regardless, your attorney should be the one to decide whether to challenge the other firm on that ground. It may be that because of the experience and knowledge of the attorney representing your husband that it will be better in the long run to deal with his attorney. If you make him get another attorney, he may get angry enough to drag the case out.

If my spouse put my name in the title of a property, is it then considered marital property?

Answered by attorney Richard Eric Anthony Dwyer
Divorce lawyer at Richard E.A. Dwyer, Esq
You can now argue that your husband made a gift to the community as evidenced by the change of title.

Can I take my ex to court for not paying a car note?

If your name is on the title and the car, the car is yours and you can get the help of the police to get it for you. Then you can return it to the seller and hopefully not lose too much money. Or, at risk to your credit rating, you can simply do nothing until the lender repossesses the car. You can assit the lender by giving him your ex's address.
