There is no set age but it appears your children are a little young to talk to the judge. Certainly they are not old enough to tell the judge the parent with whom they want to live. They could tell the judge what they observed and whether a parent beat them.

He will have to file a petition and try to serve her. That may involve making a search, possibly with the assistance of a process server, and filing a request to serve by posting a notice in a newspaper. This can be time consuming and expensive.

Why try to hid the facts. They will have to come out in court and the discovery process would allow them to be learned. I like to put as much information as possible and allowed to let the other side know that I have them by the short hairs. Now it may be inappropriate to put in an affidavit, but if you have letters or emails which support your position, I would attach them as exhibits. But that is just me.
