How can I find out why my ex is not paying spousal support that the court ordered him to?

Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
You're correct course of action would be to file a motion seeking enforcement of the child support order. If your ex has some excuse why he is not making the payments, I suspect you'll find that out then.

How do I get judgment for a divorce paperwork?

default-avatar
Answered by attorney Troy T Gorman (Unclaimed Profile)
Divorce lawyer at Gorman Law Group, PC
If both parties are in agreement, you can hire an attorney to handle the divorce for both of you. Technically, the attorney would only represent you, and he would have to acknowledge that he understands that and is agreeing to proceed without his own representation. I would of course recommend that he hire his own lawyer, but he certainly does not have to. If both of you are able to agree to a judgment regarding any spousal support, child support, parenting time, and the division of any assets, then it can be handled by your attorney for a few hundred dollars, instead of the thousands that a contested divorce can cost.

I'm divorcing and my name is on the loan to the wife's car, how can I get my name off the loan?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
If you have an attorney, talk with him or her. If you do not, you should ask her to explore borrowing the money to pay off the loan and then you can sign over your interest to her. If she cannot borrow the money, then the decree should state that she must pay the loan and when it is paid off, you will sign off your interest. It should also state that she will indemnify you for any payments that you have to make on the loan. That is important because if she files bankruptcy in the future, the property settlement is not dischargeable and she will still owe you the money.
