In the state of Wisconsin, you need to make diligent efforts to serve the other party. Your 1st step is attempting him to get served personally. This can be accomplished by hiring a legal process server to attempt to serve your husband at your husband's last known address. If the process serves is unable to serve your husband, the process server can run a postal check and determine if your husband left a forwarding address for his mail. The process server can run a check with the Dept. of Vehicles and determine if he has a valid license and his last known address. The process server can also do an internet search on criminal data bases to determine if he is in custody or has had contact with the criminal justice system. You can also send a certified letter to your spouse's last known address. Once you've complied with this due diligent search for your husband, if you are still unable to locate him then you can request the Court to allow you to effectuate service on your husband via legal publication. This means you pay for a legal publication to provide notification to your husband. In Wisconsin, Courts grant this petition one you have made diligent efforts to locate your husband.
