Generally, you may modify the terms of an existing agreement, by entering into a new agreement containing the new terms, which is executed with the same or greater formalities as the original agreement. If the original agreement was submitted to the court for approval and/or incorporation in the original final judgment, then the new agreement should be as well. Consult with an attorney who can review your documents and discuss the specifics of your situation, and your options.

  You may think there are no assets, but perhaps there are some assets.  For example, did the husband have any type of retirement account through his employment?  Also, she may be entitled to some of the appreciation on the value of the home, even though the husband owned it before marriage.  There is a formula used (referred to as the Kaa case) to determine just how much of the equity of the home she may be entitled to receive. Also, she may be entitled to alimony, which is based on need and ability to pay, and if they have children together, and she earns less than him, child support as well. As long as you have kept your premarital land in your name only  and have not added your spouse to the title, it is most likely your separate non marital asset.  If however you have invested marital funds into the land for improvements, or have spent marital funds to maintain the property, or to pay taxes or insurance, your spouse might have a claim for marital funds expended on your separate property. Further if you collect rents from the property those rents might be considered marital income.
