Will I legally have to pay spousal support while separated? Why?

default-avatar
Answered by attorney Julie Anne Ringquist (Unclaimed Profile)
Divorce lawyer at Law Office of Julie A. Ringquist
Paying spousal support has nothing to do with whether you have a girlfriend. If one spouse earns significantly more than the other spouse earns (unless the other has proven in court that the low earning is capable of earning more), then temporary spousal support will be ordered pending the divorce. Generally, the support will be for half the length of the marriage if it was a marriage of less than 10 years.

Questions regarding Cobra after divorce

Answered by attorney Cindy S. Vova
Divorce lawyer at Law Offices of Cindy S. Vova, P.A.
You should have been notified about your rights to COBRA once the divorce was final.  However, are you sure your now ex husband notified his employer that you are divorced?  You might still be on his insurance if he did not tell them.  Of course, this is fraud, so instead of waiting, you should contact the employer's HR department and check on this yourself.    Also, you usually have a 30 day period when you are still covered, so since it is only slightly over 30 days maybe they are just behind.   The fact that your divorce decree does not reference the health insusrance only means that your husband has not agreed to provide further health coverage for you. COBRA is typically expenive so you will also want to find out the cost and then consider pursuing other health insurance options for yourself.  They are all awful, but I hope you find something  that will serve your needs.  If you send me a confidential email I can recommend someone who is very helpful in getting insurance for people in your situation. Best of luck, Cindy S. Vova Law Office of Cindy S. Vova, P.a. Broward/Boca Raton info@vovalaw.com 954-316-3496/561-962-2785

Will divorce have any effect on my green card?

Answered by attorney David Nabow Soloway
Divorce lawyer at Kennedy, Nalepa & Soloway, P.C.
Sorry to hear of the problems you have endured. Permanent Residents certainly may divorce their spouses, and that should have no impact upon the Permanent Resident's immigration status. If the Permanent Resident applies to become a naturalized U.S. citizen, after initiating divorce proceedings just several months after enter the U.S., the USCIS might apply heightened scrutiny about the validity of the marriage and the intention of the foreign national at the time of entry into the U.S. and the time of approval of the adjustment of status application. It would be wise to accumulate a strong set of documentary evidence to show that you and your spouse lived together in a bona fide marriage notwithstanding that it ended in divorce soon after you got your "Green Card," and this also might include arrest and court documents relating to the charges of domestic violence. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.
