Well, what you need to do before you mess everything up is have a full discussion with a family lawyer. If you leave the state with the children you will be ordered to bring them back and you will not be able to file a divorce in another state. You have to file the divorce in Florida.

You need to set up an appointment with a local divorce attorney to find out what the options are concerning these questions and more. You might think about filing bankruptcy if you qualify, prior to the filing of a divorce. There are many options and many ways to negotiate difficult situations where both of you can be satisfied with the result, but it takes attorneys on both sides and a strong mediator.

If there is no agreement this is an issue for the judge to decide. You need to ensure you ask for "unequal distribution" in the Petition as to equitable distribution.
