No, he cannot be around guns. (Neither can your son - just asking for him to be a felon in possession.....) And it is highly unlikely that the parole officer would agree that he could live near an ex-con.

My son is currently sentenced to 40 years in california prison his appeal just got denied in the 9th distric,can he i do anything else?

You should seek the advice of an appellate attorney who does federal appeals.  It sounds like this just occurred, the decision by the 9th Circuit Court of Appeals just occurred.  There are deadlines so make sure you seek the advice of an attorney so that they can give notice of appeal to protect your son's ability to appeal.  DO NOT DELAY as there are strict timetables for the right to appeal. Good luck...

You need to contact an attorney immediately so they can file a Motion for New Trial and/or a Notice of Appeal.  There are certain deadlines so do not delay today.  I cannot tell by your post if this was a Class C Assault or a Class A assault. Certain cases can be expunged if this was a Class C assault.
