Can the police search the garbage I put out for collection in the alley behind my house without a warrant?

Jeralyn Elise Merritt
Answered by attorney Jeralyn Elise Merritt (Unclaimed Profile)
Criminal Law lawyer at Jeralyn E. Merritt
Generally, police are not required to obtain a search warrant to search or seize garbage that you place outside your home for collection. Courts, including those in Texas where you are from, hold that there is no reasonable expectation of privacy in such discarded trash. Once a person places his trash in the location for pickup by the trash collectors, where it is accessible to the public and likely to be viewed by the public, that person no longer has a reasonable expectation of privacy in the trash. Further, it makes no difference whether the police or the garbage collector retrieves the bags. Once a person places trash bags containing contraband next to a public thoroughfare for collection, he exposes them to the public-at-large, including the police. If the police had come onto your property to seize the garbage, it would be a different story. Your home is protected by the Fourth Amendment. But such protection does not extend to the alley behind your home, or even to the sidewalk in front of it.

What is my legal exposure and what should I do if I am asked to pay money that I didn’t owe?

You can not be charged for theft or fraud without you having more involvement than what you have stated. It is highly unlikely that they would recover any monies from you. The people made the agreement with the tenant and therefore must recover the monies from the tenant. Someone can always file a lawsuit against you, it does not mean that you will be held liable. You should consult a civil law attorney in this matter if you are concerned about the ramifications of telling the people to bug off and not pay them.

My daughter had a collision and left the scene this past evening and she reported it today but officer wants to come question or get lawyer first

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Rick Oliver
She needs to hire an attorney. Let the attorney speak with law enforcement. If she was involved in a collision, and left the scene, she could be facing serious criminal charges. If only property was damaged, it could be a misdemeanor. However, if anyone in the other vehicle was injured, she could be facing serious felony charges.
