Can my wife get a plea agreement for a third degree felony?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)

No, she needs a lawyer. If she is indigent, she can ask for a court appointed lawyer. If she is not indigent, then you must hire a lawyer. Only a fool represents themself - lawyers included.

What do I do ?

Answered by attorney Kenneth G. Wincorn

This can be expunged if you get deferred adjudication. Request it and when you can afford it you can hire a lawyer to get it expunged.

WHY DOES MY APPOINTED LAWYER WANT ME TO TAKE A DEAL FOR SOMETHING I DIDNT DO?

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Rick Oliver
The decison of whether to accept or reject a plea offer is yours and yours alone. Your attorney cannot "force" you to take a plea. I wouldn't venture to guess at why he or she wants you to take the offer, without having an opportunity to review the evidence the state does or does not have. If you don't want to take the advice of your appointed lawyer, your only option is to hire a different attorney who will be willing to set the case for trial.
