What is the statute of limitations on child sex abuse?

Answered by attorney Laurie A. Schmidt
Criminal Law lawyer at 5280 Law Group
In Colorado, there are a few crimes that might not be barred by the statute of limitations, those include sexual assault on a child if the assault/incident occurred after July 1, 1996. However, this does not include all sexual assault crimes against a child, some crimes could be barred 10 years after the victim/child turns 18.

Can I get a deferred sentence for a class 5 felony with no criminal history?

Answered by attorney Laurie A. Schmidt
Criminal Law lawyer at 5280 Law Group
My advise would be to obtain an attorney. You face felony theft charges, which can have serious consequences in your life, including your ability to get a job. As to your specific question, I am not sure if you would be able to obtain a deferred sentence. The DA would have to agree to allow a deferred sentence and it would be based on more than just a criminal record. Good Luck!

Where is a juvenile going to be held during a course of legal trial?

Answered by attorney Paula Wasserman Drake (Unclaimed Profile)
Criminal Law lawyer at Law Offices of Paula Drake
If a Juvenile case is going to actually be tried, then that juvenile has counsel. You should ask his/her attorney how long the trial will last. Likely you would already know if the juvenile is incarcerated in the juvenile detention facility, is released on a form of house arrest, or is merely released to the custody of the parent while the case is pending. If your question refers to a case that is at the beginning i.e. has not yet been to court, then the issue of detention vs. release is usually determined at the first hearing; further, the length of time that the case takes to go through the system varies depending upon numerous factors.
