When you get a deferred judgment does it go on your record as a felony and then get wiped off after your probation?

Jeralyn Elise Merritt
Answered by attorney Jeralyn Elise Merritt (Unclaimed Profile)
Criminal Law lawyer at Jeralyn E. Merritt
Under the terms of a deferred judgment, the court requires you to plead guilty but does not impose a sentence. Rather, you are placed on probation for a period of time, and if at the end of that time, you have complied with all the terms of probation and not committed another crime, the case is dismissed, which has the effect of vacating your guilty plea. A conviction is not final until there has been a finding of guilt (through a guilty plea or jury verdict) and sentencing. Since no sentencing will occur while you are on probation, you are not considered to have a conviction during this period.

Should I take the plea bargain if I'm innocent?

default-avatar
Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
No one can make that decision for you. The terms of the deal offered you are known. The risk of loss at trial carries with it sentencing to the time specified under the statute you are tried on. Your attorney should be advising you on the risk/reward analysis of deal vs trial. If you don't have counsel, you are on your own.

What if I was on probation and left the state?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
If the threats are prove able then likely no consequence but if not or it's a long time since then there may be a problem A petty offense is usually not a big deal.
