Can you be jailed for not paying a debt?

Jeremiah D Raxter
Answered by attorney Jeremiah D Raxter (Unclaimed Profile)

You cannot be placed in jail for failure to pay a debt. If fact, if they are truly threatening you with jail, they are in fact breaking the law. You should consult an attorney. Good Luck!

What options do I have to bring my mortgages and payday loans current?

Answered by attorney Athena Inembolidis (Unclaimed Profile)
Bankruptcy lawyer at Athena Legal, LLC
A chapter 13 bankruptcy might be a good fit for you. A chapter 13 allows you to catch up your mortgage as well as slowly through a court approved plan. You should talk to a reputable bankruptcy attorney to discuss whether you qualify.

Can I file bankruptcy for child support arrears? How?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
Since child support is never eligible to be discharged in a bankruptcy, Chapter 7 is unlikely to provide you with much wiggle room to solve this problem. Chapter 13 would allow you up to 5 years to catch up on the child support arrears but you will be kicked out of the Chapter 13 program if you fail to make the ongoing child support payments.
