Are judgments included in Chapter 7 bankruptcy?

Yes, you must list all court judgments in your bankruptcy. Judgments can be a complication especially if you own real estate, so make sure your attorney is familiar with liens and is aware that these debts are also judgments.

What can I do if my bankruptcy was dismissed because of my attorney?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
I am not certain your situation. You can talk to a more experienced chapter 13 attorney to see if they can help. But, if your current attorney is experienced then they should be able to explain that process. Chapter 13s are complicated and it takes an experienced attorney to deal with the more complicated issues. Again, I cannot tell from your question exactly what is happening.

Can they take my car if my case was dismissed in March and I have re-filed chapter 13?

If you had a previous case with in a year and you re-filed another Chapter 13, the Automatic Stay in the current case expires in 30 days from the date the current case was filed. In order to extend the Automatic Stay, your attorney will need to file a Motion to Extend the Automatic Stay which should protect your car from repossession.
