Yes, generally liabilities for alleged overpayments by these entitlement programs are dischargeable as long as there was no fraud involved in obtaining the money in the beginning. However, if you are still getting checks from the VA or are entitled to receive money but for the alleged overpayment, The VA can exercise a right to "set off" against any monies you may be entitled to for VA disability or VA retirement notwithstanding any Bankruptcy of the overpayment.

I am assuming that you are asking if someone who has filed bankruptcy may rent property s/he still owns, and the answer is yes. A tenant has not right to dictate how the landlord uses the rent money. Nevada law does provide some protection for tenants in this type of situation.
