Can I withdraw my 401k before filing for bankruptcy?

While you can certainly withdraw money from your 401K to pay for the bankruptcy, it may not be a good idea. First and foremost, most of the time, money in a 401K is exempt property. Once you convert that to cash, it is no longer afforded exemption status. If you need to withdraw money from the 401K, only withdraw enough to pay for the Chapter 7, which is generally $1,500.00.

No one can tell you why the attorney did not file the affirmation agreements. As that relates to the mortgage the debt was discharged, thus taking it off of your shoulders. You can contact the credit reporting agencies and see whether you have the ability to get them to recognize that you have paid for the last two years. It may take contacting the lender in order to get them to correctly reflect the payments you have made.

I filed Bankruptcy to stop foreclosure the bank was still able to foreclose what legal actions can I take?

Once a foreclosure is completed, bankruptcy won't help you unless the foreclosure was illegal by taking place after the bankruptcy was filed and without bankruptcy court permission. Since it appears that four years have elapsed since this foreclosure has taken place (as you say the foreclosure went through back in 2008), it may be far too late for you to do anything. You cannot short sale a property that is no longer yours and you haven't provided enough details to show me one way or another whether this foreclosure was illegal or not. In any event, what damages did you sustain? If the property had equity, you might have sued back in 2008. Why bring this issue up 4 years down the road?
