Your husband can file bankruptcy even if you are not divorced. Unfortunately, if you co-signed you will be responsible for the debt.

Will I be able to get federal student loan with permission from the court and can the federal loan department deny me if I have the court’s permission

Diane L Drain

Most likely your student loan is not "in your chapter 13 bankruptcy". It would be listed in the bankruptcy, but paid just like your other unsecured debts. Here is the problem, I cannot guess as to your situation or the answer to your question. The law is the same in all 50 states, but local rules, general orders, policies and procedures differ from state to state. Therefore, you really need to talk to a competent chapter 13 attorney where you live. If you live in Arizona then I can give you some referrals.

What happens with my student loan while in bankruptcy?

Answered by attorney John F Brennan (Unclaimed Profile)
Bankruptcy lawyer at Musilli Brennan Associates, PLLC
Student loans are normally nondischargeable in bankruptcy. As you filed bankruptcy in 2010 I would've hoped that you would've had attorney at that time to help counsel you. You could also talk to your local university and term and whether or not there is some program or grant to you might qualify for in order to complete your education given your hardships.
