That depends on when they were garnished.  Were they garnished before you filed bankruptcy, or after?  If before, you probably won't get them back.  If after, you'll usually get them back after your discharge is entered, and possibly sooner if your attorney properly informs the sheriff's department and the creditor.   Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.  CONTACT MARK for more information or to schedule an appointment.

If you are in a position to pay the additional debt after the loan modification, then you should discuss with your attorney whether dismissing the bankruptcy is the best course of action.
