On one hand, you have $10,000 of unsecured debt that will be dismissed in the Chapter 13. On the other hand, you have to modify the Chapter 13 plan to make the new mortgage payments and that will affect how much will be paid to the unsecured creditors. You need to run the numbers both ways and decide which is your best option.

No one can force the sale by such an agreement.  However, I bet there is more mess to this.  Are the shares in both names?  How is it titled?  Bankruptcy is an easy way out of this mess, given the credit card debt.

Upon confirmation of your plan your property vests in you. You income is still part of the estate. If you want to pay off your bankruptcy sooner than three years you need to pay your unsecured creditors in full, even if your plan provided for only partial payment. After three years you can ask for a payoff from the trustee.
