How do I get compensation for my injury on the job?

Answered by attorney Mark L. Smith (Unclaimed Profile)
Personal Injury lawyer at The Law Offices of Mark L. Smith
Yes you are entitled to a settlement, but no the type of settlement you think. Because this is a work-related injury you are only entitled to receive the statutory fraction of your previous wages and the payment of all medical bills related to the accident. Your will not be compensated for pain & suffering. The settlement will be for a resolution of your future earnings, but remember if you do settle and have to go to the doctor for your injury you will no longer be able to have the insurance company pay for the work related visits.

Do I have a personal injury lawsuit if my airbags did not deploy in an accident?

Answered by attorney Steven A. Schwartz
Personal Injury lawyer at Joel H. Schwartz, P.C.
You would need to prove that the airbags were defective. In order to do so, you will need to hire an expert to inspect your car to see if they were faulty. This will costs thousands of dollars to do. Even if you find one successfully, the defendants will have an expert of their own to combat your expert's findings. Assuming the airbags are defective, you will then have the burden of proving what ADDITIONAL injuries you received as a result of the airbags not deploying properly. In other words, you need to be able to show your injuries would have been different had the airbags deployed. This is a very difficult thing to do considering your car flipped over. If your injuries are not severe, I don't think it is worth pursuing any further. These are extremely expensive claims to prosecute, and you will probably be wasting your time. In any event, you can always contact an experienced personal injury attorney in your area for a consultation.

Can I hold someone legally responsible for causing an auto accident?

Answered by attorney John F Brennan (Unclaimed Profile)
Personal Injury lawyer at Musilli Brennan Associates, PLLC
I would need more details, but generally I do not believe that you have defined a cause of action against the new girlfriend. If you believe that she is being overly aggressive your correct action would have been to make a complaint, or if you are driving, drive the police station. I certainly hope that you were insured and, if so, you should be contacting your insurance company immediately to make a claim.
