My daughter was injured in a car accident in the summer of 2006 in Orange County, California. The case was settled about 2 years ago. Her lawyer said that the case had gone to trial and therefore withheld a larger commission. My daughter says it didnt go to trial and therefore he owes her money. Since the case was closed she has tried to contact him many times but gets no response from him. I want to know if she has a case against him and if so what is the statute of limitations on this please.

The statutue of limitiation in Califonria for professional negligence is one year.  Depending upon the circumstances he year can start from the date of the negligent act, from the date the harmed person discovered (or reasonably should have discovered) the negligent act or from the date of the harm. In the case of attorney malpratice the year does not begin to run until the attorney/client relationship terminates.  There are various exceptions, including exceptions for minors.  It is best to consult an attonrey regarding a particular set of circumstances This particular issue sounds more like a contract dispute (four year statute of limitaion) than a malpractice. A couple of suggestions:  (1) By registered mail, ask the attorney for the entire file.  This way you can look to see what the retainer agreement says and how far the case actually proceeded. (2) Make a complaint to the State Bar of California.

My glass shower door spontaneously broke. Do I have a legal recourse?

Don't believe tempered glass shower doors typically shatter absent some defect in them. No surprise that the manufacture tells you that and if they are aware they can spontaneously shatter, did the literature they provided at time of purchase warn about that risk? If the materials did not warn about that risk, you can allege they were aware of a significant risk of injury or property damage and failed to warn about that risk. So believe you would have two separate theories of product liability; defective product and failure to warn of a known danger.

How do I go about finding and prosecuting a person who is using all my personal information?

Answered by attorney Ernest Lee

The state and federal governments both have agencies and other resources to combat identity theft. One place to start is the U.S. Department of Justice.
