Be polite but persistent. Call the nurse again. Go on what you know, not what you think maybe. You know that your children need medical attention. If you can't get in to this pediatrician, then see if there is some outpatient clinic you can go to.

It certainly would be upsetting to hear that close to a statute of limitations that there is no case. Sometimes it does take a long time before a determination can be made if there is a case or not. The problem is, if it is true there is no case, you would not be able to prove any damages caused by the close to the deadline response.
