The devil is in the details. the question is can you prove negligence or a breach of duty by the coffee house. The lawyer's which you consulted thought not. Keep trying, at least a few other attorneys. If they all turn you down then take a hint, perhaps you do not have a case.

Yes you can. Your neighbor's contractor broke it, it's up to him to fix it. If he can't figure it out, he should get someone who can. Meanwhile, get a hold of your insurance company. It might be easier for you to put in a claim with them, get the situation rectified, and then let them chase the contractor to get their money back.
