For a medical malpractice case to be worth pursuing there must be substantial permanent injuries. These kinds of cases are expensive and labor intensive. Only a severe injury warrants the costs, commitment and risk of loss that an attorney must assume. You have a two and one half year statute of limitations. See how you do and if you think it's that bad then hire a lawyer and go for it.

In order to prove a medical malpractice case, a claimant must prove a failure to conform to accepted practice, resulting in an injury. A bad result is not enough, and if it is a "judgment call" by the doctor, there is no malpractice, even if the doctor made the wrong call. You will need to get copies of ALL of your medical records and have a surgeon review them; if he/she is willing to testify that your previous doctor(s) failed to conform to accepted practice, then you have a case.

If older brother signed authorization for move her hr should know where they sent her. He should have read the authorization form and asked for a copy when he signed. Now you're stuck with all kinds of Federal and state regulations prohibiting disclosure of patient information without proper authorization (e.g. HIPAA).
