Since I've been out of the US for 8 months, how will that affect the required income needed?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
This looks like a situation that cannot easily be resolved. K1 processing through both USCIS and the State Department will likely take longer than three months. An expedite will be both expensive and 'may' prove futile. You will eventually or likely need your family to act to show it can support you. If you overstayed a Honduran Visa, then the U. S. may be unwilling to accept the applications for 'more expedited processing. However, that's unclear without further negotiation. It's unclear whether you can afford an attorney. The visa laws are rather insensitive to your situation. I wish you luck, but be prepared to deliver the child without him unless the child will be born in Honduras and seek a certificate of birth abroad. This may be an additional challenge.

Will my DACA be denied because I entered the US under a false identity?

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
No one knows how these issues will affect the case because the rule is so new. Frankly, in my personal opinion, it seems you have a good chance, but it may boil down to how you truthfully tell your story, if asked. However, my personal opinion may not be the way that DHS sees it, and no one knows how tough they may be on these cases.

What steps do I need to take to apply for permenant residency?

Answered by attorney Renea Overstreet
Immigration lawyer at The Overstreet Law Firm
You may be eligible to apply through the I-212 and then the I-601A Waiver along with an I-130 and application for adjustment of status. Once an attorney gets a full time-line of events, you may be able to start a process that would lead to a legal status.
