Is it sufficient to sponsor my brother and sister if my salary is $73,000 and my wife’s income is $30,000?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
According to the applicable poverty guidelines, your income would be sufficient to sponsor two siblings even if you, yourself, already were to have many legal dependents. Perhaps more important to address, however, is the very long backlog for visas in the Family-Based Fourth Preference (FB4) visa category (siblings of U.S. citizens). Although it may appear to be a shorter time, because less than a year's worth of backlog may be satisfied each year, and Priority Dates may progress or retrogress significantly, it may take 15 - 20 years (or even longer) for a visa to become available in that category. For this reason applications in the FB4 category rarely are satisfactory solutions, and it often is appropriate to explore other immigration options (such as employment-based applications) to achieve one's goals.

What should I do about my surname?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
If you are close to the time you can apply for citizenship it should be fine to take care of the name change at that time (A name change with the citizenship application means you will need to be sworn in by a Judge but in many districts this is required anyway). I would notify social security and DMV immediately as that will not need to be re-done after citizenship. If you are not filing for citizenship quickly then I recommend you file an I-90 to get a new green card in your new name and/or travel with an original of your marriage certificate until it is finalized.

What steps do I need to take to get my husband back?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. The short answer is that you will need to file I-485 and supporting documents. You may also need to file a waiver.
