Sanctions for driving without a valid driver's license are determined by the criminal statutes of the state in which an arrest is made. Aside from such sanctions, some jurisdictions participate in a program known as "Section 287(g)" by which local jurisdictions get involved in immigration law enforcement functions; in these jurisdictions police may report to immigration authorities the unlawful presence of someone stopped for a driver's license infraction, and this may lead to detention and removal. Depending upon your uncle's circumstances, there might be avenues for seeking immigration benefits, such as the circumstances by which he previously applied for a "Green Card." It would be wise for your uncle to obtain a thorough understanding about the reasons his previous application was denied (and he should obtain copies of the application and the Denial Decision), and he should consult with an immigration attorney he trusts in order to now obtain advice about immigration eligibilities and options.

First, it sounds like he has been illegal in the U.S. already. Depending on how long he was here he is probably barred from entering the country. More than likely you will need a waiver of his inadmissibility. Secondly, being married in Mexico is a good first step to bringing him to the U.S.. The marriage or fiance status will provide the family relationship needed to immigrate through you. Although there may be a good chance that your boyfriend can some day be legal, the entire process may take several years.

All prior marriages must be legally terminated before your marriage will be considered valid for immigration purposes. The divorce may be filed and completed in Mexico or in the United States as long as it is legally sufficient.
