He does not need to wait 10 years. He can apply for a waiver. The main issue here is whether he is inadmissible on other grounds.

Is there any hope for an illegal immigrant who has been arrsted on drug charges?

Evelyne M Hart
Answered by attorney Evelyne M Hart (Unclaimed Profile)
Immigration lawyer at Hart Immigration, A Professional Law Corporation
Dear Veronica, If he was charged with drug trafficking or conspiracy, this is an aggravated felony for immigration purposes and is a very serious charge.  If this is the case, more than likely he will be deported. The best thing you can do right now is obtain a CERTIFIED record of conviction from the court (Court Minutes) so that an attorney may properly analyze the immigration consequence of the crime.   Evelyne M. Hart, Esq.
