Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
Your wife can petition for you by filing a I-130 relative petition with USCIS. If you were unlawfully present in the U.S. in excess of 12 months, you will be required to file a waiver on form I-601 in order to return to the U.S. within 10 years of your departure.

Requirements for EB and TN visa.

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Hi. You only need an I-129 if you extend in the US via the Service Center. When you TN is about to expire, you can file in the US or go back to the Consulate like your initial application. Thus, you do not need to file the I-129. To access your qualifications, I would need more information about your full background, the job and the company. You can always call or email for more information.

How long does an I-130 take to be approved?

Answered by attorney M. Gabriela Ungo
Immigration lawyer at GC Ungo Immigration
The basis of an I-130 petition depends on the family-relationship category of the foreign national to the US citizen or LPR. Immediate relatives are usually pending 7-8 months if they are consular processing the case.
