Looking to get my Certification of Citizenship and was hoping you all could advise me being that my Permanent Resident Card has expired as of 2/28/18

Answered by attorney Alan Lee

The Child Citizenship Act became effective in 2001 and allows automatic citizenship to a child where a parent is a U. S. citizen, the child is under 18 and a lawful permanent resident, and the child is in the physical and legal custody of the U. S. citizen parent. If all the conditions were met and you were under the age of 18 on 2/27/01, you can make an application for citizenship on form N-600 Application for Certificate of Citizenship. I’m almost 21 years old and I would want to know what am I going to need to fix my Mom’s papers?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
If you are US citizen, you can file I-130(visa petition) once you turn 21. Your mother may not adjust her status unless she entered the US legally. In addition, even if your mother may receive green card, your brother may not receive his at the same time.

Can immigration deny my marriage because of a large age gap?

No, you will not be denied based on the age difference. You just have to be able to prove that you have a real, good faith marriage.
