Technically, that is correct: An immigrant visa means that the intent of the person is to permanently move to the US, whereas the intent of a B2 tourist visa is to visit the US briefly and return home. Thus, there is a conflict, and it is very possible that your brother will be denied a tourist visa if his immigrant visa is pending.

How did your husband enter the USA? If he entered without inspection (EWI) then he would likely have to go back. However, he can apply for a waiver, and have the waiver in hand when he goes to Juarez for his appointment. If he entered with permission, then you can likely do a change of status without having to go back.

In my practice, sham marriage determinations are often idiotic but it makes them no less difficult to fight - and you absolutely have to fight this determination, within the agency and, if necessary, in court. Otherwise, your husband will be deported and never, under any circumstances, permitted to come back. Even convicted criminals can get some lenience; but sham marriage means a life-time bar to admission to the U.S. Call the local chapter of the American Immigration Lawyers Association and ask for a referral.
