Your employer can petition for a change of status from B1/B2 to H-1B as long as you remain in status when the petition is submitted. The earliest that the petition can be submitted is April 1st of each year, and the earliest date that you can start working is in October of the same year. The petition is submitted on form I-129.

You should be fine in filing your petition to remove the conditions on your residence even in a divorce situation as long as you have sufficient documentation establishing the bone sides of your marriage.

Will annulment affect an immigrant chances of green card?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. Did the immigrant marry in good faith or was it for immigration purposes only? I strongly suggest that the immigrant contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding his/her situation. (S)he would then be in a better position to analyze their case, and advise them of their options.
