What to do when there is a pending i130 application and the i94 expired?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
More information is needed, but this question is best answered at an appointment with a competent and experienced immigration attorney. You may set off an unlawful presence bar based upon the I-94. Your absence from your nation can create concerns over whether you are withholding information from a consular official, which can create an indefinite ban on lawful immigration. The unknown facts in combination with the strategy creates serious concern.

Would the US government deny my petition for my mother’s visa if I applied for food stamps and cash help?

Immigration lawyer at Orbit Law, PLLC
Yes. When you file for a relative to come to the U.S, you must also submit an Affidavit of Support which requires you to show that you make at least 125% above Federal Poverty guidelines; therefore, if you, as the sponsor are yourself on cash assistance and food stamps, you will not be able to show that you have enough income to support yourself, your family AND your mother. As you are already a "public charge", the petition for your mother is likely to be denied if the Government thinks that she too will become a "public charge".

My brother, who I have sponsored and has been granted a visa to the US, wants me to sponsor his 4 yr old child too, what do I need to do for the child

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The assistance that your brother is asking from you does not appear to have much success potential. It would take a very sympathetic US consular officer to grant a visiting visa to a small child and for someone who is not a parent to take care of him while in the States. This would especially not look good if your brother and his wife have visiting visas to the United States also (which I assume they have as you sponsored them). Questions would be why they did not present the child to begin with when they applied for their visas, and also why they need the mother-in-law to take care of the child if they are here in the US on visiting visas. Would the answer be because they are illegally working in the States?  I suggest that you might ask your brother to reconsider his request to you if this is the case.  Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
