F-2 to F-1 COS with name mentioned in Spouse's pending I-140 EB2-NIW pettiotion?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Our viewpoint is that the I-140 petition is for the principal applicant and not for any dependents who are mentioned on the I-140 petition. Everything being equal, your wife should be able to file for a change status to F1 successfully. If she is in the US and applying for a change of status on form I-539, there is nowhere on the form to ask whether she has immigration intent. It is your choice as to whether to file the I-140 and have it approved first or file it with the I-485 adjustment of status applications provided that your priority date is current. If you decide to submit the I-485 applications at this time, your wife would forgo making an application for F-1 as she would already have applied for permanent residence.    Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. What can I do if my husband has taken my green card by force?

default-avatar
Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
Your husband cannot force you to go to Pakistan. He has no right to force you to give your passport and green card to him, or to his parents, or to anyone else. Your passport and green card belong to you, personally, and not to your husband. If you husband uses force or coercion or threats to bend you to his demands, he violates the law. If you have a permanent, 10-year green card, and if you are a permanent resident for 5 years, you can file for U.S. citizenship - and you don't need your husband's permission to do so. If your green card was issued only for 2 years, and your husband did not file papers for a 10-year green card for you, you need to speak with an immigration attorney as soon as possible. If you need help, you can call Safe Horizon at 800.621.4673. They have huge experience with this kind of problems, and can help with advice and, if necessary, with getting away from your abusive husband. There are other non-profit organizations that help women who are abused or threatened; you can look them up on-line or call 311 and explain what you seek. If you need legal assistance, feel free to call our office.

Is he still eligible for a K1 visa?

Answered by attorney Charles H. Kuck
Immigration lawyer at Kuck Baxter
No, he is not, he would have to leave and would have 5 year bar. I STRONGLY suggest marrying here and just applying for the green card. He would have it in about 90 days.
