You must apply for the PERM and it must be pending for at least 365 days. Then, you can get yearly extensions. *PERM Labor Certification* A Labor Certification is an application filed by your future employer. Labor Certification is now known as PERM and moves through the system much faster than before. In fact, if everything goes smoothly, after filing the Labor Certification, it could take only 60 days. This is years faster than before. It is an offer of employment that will allow you to work for that employer when you get your Green Card. My office prepares the paperwork and application and then sends it out for signature to you and your employer. We guide both of you through the entire process so that you will never wonder what to do next. Please note that even though the Labor Certification process is much faster, that it is still taking years for the visa number to become current.

Since he came back after being deported or "sent to Mexico", he has triggered the permanent bar. What it means is that he has to go back to Mexico for 10 years before he can come back on your petition. At that time, he will still need a waiver if he was deported. (He may also need a criminal waiver depending on the criminal statute he was convicted under). I do recommend that you see a competent attorney to explore other ways to help you including but not limited to U.S. visa if he was a victim of a crime.

She will need representation. Removal/Deportation Representation It is critically important that you get qualified and expert representation for the deportation/removal hearings. The Government will try to get the deportation issued. Neither the Immigration Judge, nor the Trial Attorney are there to help you. There are different forms of relief available which could result the granting of Lawful Permanent Residence. However, this requires large applications to be prepared and the necessity to prepare for trial. My firm has done this for several years, and if done properly, there is a very reasonable chance that it will be successful. If not done properly, the deportation order will be issued and your current way of living in the United States will end and you will either be on the run or be forcibly removed from the United States. Attorney Fees (Filing Fees and Costs not included).
