Click on most recent bulletin and scroll to the family based chart. Find your box. When the I-130 filing date appears there, she can file for her green card. Whether she needs to depart or not depends on her current status in the US. Please seek a full consult with a competent immigration attorney to determine that issue.

While requirements for a marriage are based upon the laws of individual states, rather than federal law, generally someone may become married regardless of their immigration status. Marriage, by itself, does not create any immigration-related benefits, but depending upon other facts may form a basis for a successful immigration application. For example, someone who entered the U.S. lawfully and with inspection, and who then marries a U.S. citizen, may apply to adjust status (to get a "Green Card") regardless of whether he/she may have overstayed a visa or may have worked without authorization. It would be wise to consult with an immigration attorney, even before becoming married, so that the attorney, after learning all of the relevant information about you and your fianc?, would be able to advise about immigration-related eligibilities, options and strategies, and would be able to represent the couple in the application process.

A visa is not a guarantee of entry into the U.S. Each time you enter the U.S., you must be inspected by an immigration officer who will determine if you merit entry under the visa that you possess. The burden is on you to show that you are admissible to the U.S. You should consult with an immigration attorney to understand what documents and information you should present upon entry to best insure that you may enter the U.S.
