How do I make my illegal husband a resident in the US?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
Is there a new law that will prevent my husband being deported? I think you are referring to the waiver application. CIS has not started the new procedure, which allows the applicant to file the waiver in the United States. You should file the visa?petition?first and then when CIS starts to accept the waiver application before the alien leaves the US, file the waiver application. Please note that the substantive law has not been changed. Whether your husband can get the waiver is still uncertain and you should retain the service of immigration lawyer to assist you in the waiver application.

How can I come to the US?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
Your spouse can start the three step green card process for you. He or she will need to locate a joint sponsor for the financial requirement or meet the asset test. Both of these are outlined in the 864 form instructions.

Can I sponsor my brother and parents for green cards if I am a US citizen?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
For your parents it will be easy as they are immediate relatives. The process takes less than 4 months in most areas of the country. Contact me if you would like assistance with the process. With regard to your brother and sister-in-law the wait time will be 10-12 years. If they are anxious to remain here, I would suggest consulting on other nonimmigrant options that would allow them to stay in the short term and hopefully one of these categories would then also open up some option for a faster green card. If not they can continue to renew their nonimmigrant status until your petition for your brother becomes current. If you would like to schedule a consultation contact my office as indicated below.
