Can I file for Adjustment of Status under 245 without my husband present?

You may be eligible for a waiver based on VAWA. If you have not done so already obtain a copy of the police report. I also suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. He/she would then be in a better position to analyze you case and advise you of your options. He/she would also be in a better position to argue your eligibility for the waiver to the interviewing officer.

Can my husband still get a green card if I divorce him?

He already has a green card. If he can prove up the bona fides of the marriage, he can get his 10-year card without your assistance. You can provide the arrest report and evidence of his coercion of you to obtain the divorce. If it is in his file, he will need to explain that at his removal of conditions interview.

Is there anything I can do to stop immigration from deporting my fiance/soon to be husband?

Brian D Lerner
Answered by attorney Brian D Lerner (Unclaimed Profile)

There are several things that can be done depending on his current situation, but I need to know more facts. *Removal/Deportation Representation* It is critically important that you get qualified and expert representation for the deportation/removal hearings. The Government will try to get the deportation issued. Neither the Immigration Judge, nor the Trial Attorney are there to help you. There are different forms of relief available which could result the granting of Lawful Permanent Residence. However, this requires large applications to be prepared and the necessity to prepare for trial. My firm has done this for several years, and if done properly, there is a very reasonable chance that it will be successful. If not done properly, the deportation order will be issued and your current way of living in the United States will end and you will either be on the run or be forcibly removed from the United States.
