I don't know what state you are from but I suggest you contact a family law attorney. In most states you are eligible for a divorce without your husband's consent. Depending on how long you have been separated you may have to give him notice but your family law attorney will know this.

Unless she is 245i protected, she cannot file I-485 to adjust her status in the US. Without I-485, she cannot get any other benefits, such as work permit or even driver's license (some state may have different rules on this). She will have to return to her own country to be interviewed. She will need waiver to waive her unlawful presence in the US. Please retain the service of an immigration lawyer as this is not an easy case.
