Do we need a sponsor if my husband is unemployment, but from last year his taxes is $33,000 which is up to the minimum?

Answered by attorney Kevin L. Dixler

More information is needed. Does Your US citizen husband currently hold the job? If so, how much is his wage? In some situations an average she can be taken. In addition, Some may be able to properly appraise their assets and use those assets to qualify for the affidavit of support. This can get complicated, so strongly recommend the competent and experienced immigration attorney. Can I get another copy of my form I-130?

Answered by attorney David H Stoller (Unclaimed Profile)
Immigration lawyer at Stoller & Moreno, P.A.
Yes, you most certainly can obtain another copy. You can use the Form I-824 to do this. Kind of a pain in the rear in that you are going to have to pay to process the application and it costs $405. Really stinks when the application fee for filing a new petition is $420. But that is the way the CIS does things. The other alternative is that you could file a Freedom of Information Act request on a Form G-639 and send it to CIS and request a copy of the file jacket containing the petition. If that is filed and CIS understands what you are requesting, they will provide you a full and complete copy of the file jacket that the government opened for the petition which was filed. May be a longshot because my experience with this is that CIS is never consistent when it comes to obtaining what you request when you file a Freedom of Information Act request. The better you specifically document what you are requesting, the better. In terms of time, you will probably wait longer to obtain a result on the FOIA request that you would on the I-824. So as they say, money talks and this situation is one where paying the fee may obtain a better and quicker result. If you have questions, consult with an attorney who understands what to do and can perhaps listen to why you are requesting a duplicate copy of the approval notice and can suggest the best course to follow. Good luck.

If I apply for public assistance, would this affect my husband's case?

default-avatar
Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
The fact that you are receiving public assistance will not affect your husband's case, but unless you meet the minimum financial requirements for the Affidavit of Support, you will need a joint or co-sponsor help you bring your husband here.
