Can I fix my boyfriend’s citizenship if he was deported 10 years ago for a felony?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. Since we do not have all the facts, it is impossible to give a completely accurate answers. With that being said and without knowing all of the details of his conviction, I would guess that he would be deemed inadmissible and unable to return to the U.S. Whether or not there are any waivers available to him to overcome the convictions would depend on many factors, including, but not limited to, exactly what he was convicted of, the drug involved, the amount of the drug, and how much jail or prison time he did. I would suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your boyfriend's case. (S)he would then be in a better position to analyze your case, (and) advise you of your options. If possible, bring any documents you have or can find related to your boyfriend's case with you for the attorney to review.

Will an absence from the US with a re-entry permit affect my spouse's pending petition?

Alan Rodolfo Diamante
Answered by attorney Alan Rodolfo Diamante (Unclaimed Profile)
Immigration lawyer at Law Offices of Alan R. Diamante APLC
A lawful permanent resident (LPR) can petition a spouse and there is a waiting period for the priority date to become current. There is no waiting period when a citizen petitions his spouse. Traveling does not delay the waiting process. However, the LPR should be careful about traveling abroad for extensive periods since it might have an impact on naturalization eligibility. In most cases, if a LPR is planning to naturalize in order to cut the waiting period for his spouse's petition, should make sure not to spend more than half of his time abroad (in the aggregate) for the last five years before applying for naturalization since that will affect eligibility.

I got a misdemeanor for conspiracy to sell a firearm can i apply for adjustment of status

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Firearms offenses make a person inadmissible, but a waiver can be requested when applying for adjustment of status assuming that the offense was one involving moral turpitude. Such waiver would be based upon the establishment of extreme hardship to a U. S. citizen or permanent resident parent, spouse or son/daughter if the waiver was not granted.
