Each person can be charged with damage to property and injury to persons, because the driver did it and the passenger was a party to the crime.

I am afraid a DUI will never go off your record. After about 10 years, you may not find it on Michigan Master Driving Record; however, it is always on the Secretary of State's and police lien system. The reason is because if you get 3 DUI's in a lifetime, under Heidi's Law, you can be a felon. It used to be 3 within 10 years. So in order to keep track of someone's DUI/OWI/OUID/Impaired driving convictions, they are always there. You can never get them expunged. Sorry, but people ask me this all the time, and a drunk driving offense sticks around forever.
