Can police search a home without a warrant that has a drug offender (pending trial) living there?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
So, you live in public housing, and you are housing a felony drug offender. That means that you know IF you are charged at any point in time with a felony and get convicted, you will not be able to return to public housing. I cannot imagine that you live in public housing by choice. SO, you have a question about your 4th amendment rights or his fourth amendment rights or the homeless shelter where you will live after you are put out of public housing. No decent housing, and no decent education. I feel sorry.

What happens if he is on probation for an MIP, have to randomly take PBT tests in the morning and blew a .02 when he didn't drink?

Sounds like he is going to be violated and will need an attorney. On the false positive he should have asked for, or procured an actual blood test.

If I cracked someone’s window then fled the scene can I be charged with anything and if so when would I be notified?

It depends. The owner of the car could sue you in civil court and they could press criminal charges against you for malicious destruction of property if the facts warrant it.
