Will my DUI stay on my record from seven years ago?

Answered by attorney Loren M. Dickstein
Criminal Law lawyer at Lewis Dickstein P.L.L.C.
Unfortunately a DUI will stay on your record forever. The only way to get such a conviction off your record would be to file and win a Motion for Relief from Judgment. This is commonly referred to as a 6.500 Motion. These motions are very complex and in misdemeanor cases often require the prosecutor's concurrence. You should consult with an experienced Michigan criminal defense lawyer.

Answered by attorney Marshall S. Tauber
Criminal Law lawyer at Law Offices of Marshall S. Tauber
No. However, it is assumed that after 15 years most charges, except homicides and charges where the maximum penalty is life, the charge is considered stale.

I would have to know the details, but an outstanding criminal warrant would certainly have a detrimental effect in your ability to for apply and be granted a passport.
