Is there a way to shorten my DUI Probation?

default-avatar
Answered by attorney Edward Jerome Blum (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Edward J. Blum
The standard sentence for DUI includes 3-5 years of probation. It is possible to shorten the probation sentence by filing a motion to terminate probation. In my experience, the prerequisite to terminating probation include the following: 1. Fulfill all conditions of probation. In a DUI this usually means pay the fine, do the classes and whatever community labor or service were imposed. 2. Wait for more than 1/2 of the probationary term to elapse. 3. Have a good reason. In this economy, its necessary to be off probation to get a good job or a promotion. Immigration needs are another good reason. After the motion is heard and granted, the defendant can move to dismiss the charges pursuant to Penal Code Section 1203.4.

When did the 10 year DUI law come in effect?

Answered by attorney Linda Kaye Frieder (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Linda K. Frieder
Effective January 1, 2007, your DUI will again report on your driving record since it occurred within the past 10 years. The department's EPN program automatically generates and mails a driver record to the employer for newly enrolled drivers, or upon any action or activity updated to the record, or annually for currently enrolled drivers.

What are the chances of my case getting dismissed if my attorney stated that he got my discovery with .08 BAC level?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
If your blood alcohol concentration is .08, or above its possible that your case will be dismissed but not without some solid legal problems with the case, not just simply .08. If your lawyer is a fighter, good things can happen.
