Absolutely not. Maybe, just maybe, you should accept the knowledge and experience of every single lawyer you talk to. There is a name for it when people go from one doctor to another until they find the diagnosis they want to hear I am not sure of one exist for the corresponding issue with lawyers. There is no chance at all that the city attorney will dismiss you case. None. Better, at trial, you will likely be found guilty because of your statement. The witnesses you may have are telling a ridiculous story; that you were driving makes much more sense.

Not unless he was on probation at the time of the 2nd DUI, which would make the DUI a probation violation. I suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your husband's case. He/she would then be in a better position to analyze your case and advise you of your options.

IF you are on probation for an alcohol related offense, and are stopped again for an alcohol related offense. You should expect to go to jail, because you cannot stop drinking and exercising bad judgment.
