That is entirely up to your attorney to try to negotiate a deal with the prosecutor and judge regarding this probation violation you will be charged with and part of the new charges, with priors. No one can guarantee you of no jail time on this, but it is a minor offense, so there is a reasonable chance of avoiding jail, or at least minimizing it. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. I'll be happy to help fight and get the best outcome possible, using whatever defenses and sympathies there may be.

It depends what the warrant is for. You or your attorney are going to have to appear before a judge if you want the warrant recalled. The next step depends on why the warrant was issued in the first place.

Your question does NOT make any sense. Line one: he was coerced. Line four he did not participate in harming the man. IF that is true what was he coerced into doing? Just standing there. He had to be coerced into just standing there. IF you want real answers be courageous enough to ask real questions. Your nephew is involved in a murder, everything else you are talking about is his version. HIS VERSION. You were not present. His version will become his defense. If the jury likes it, he walks. If not, then he faces life in prison. PERIOD.
