Since courses have a lot of discretion in these matters, you can't know the outcome until you try. Ask your lawyer to file such a request. Provide him or her with documentation showing these facts as you laid them out in your question. If it works, well and good. If it does not, you'll have a visit home which probably will include some more pleasurable activities apart from a brief court appearance.

In Texas it is a DWI not DUI if one is over 21. ? You can ask to have visitation modified so that he is not driving the children.? You can certainly ask to have him ordered not to drink within 24 or 48 hours of visitation.

I don't know what you mean about the officer suing you. But if you were in police custody and the police officer was questioning you, then he can't use what you said against you in court unless he read you your Miranda rights.
