No, that is not true. In Missouri, misdemeanor offenses, such as driving while suspended, my be charged up to one year from the date of the offense, generally.

Is hiring a new attorney will harm, benefit or make no difference for a rape case?

Depending upon the facts of the case, it may be of more harm than good. You don't say how long the process has taken and whether the conviction was by judge or jury. Understand, you hire a new attorney and he/she has to come up to speed with your case. That will be time consuming and potentially expensive because this attorney will have to learn all about the case .... information that the present attorney already knows. This is the case, whether you hire an attorney in county or out of county. Generally, I prefer in county attorneys because they know how the courts and the judges operate within that county... probably far more so than an out of county attorney. You won't be able to hire an attorney who "has business relationships with the judge", as that would be a conflict of interest and would not be allowed. By hiring a new attorney, will that result in a lower sentence?? Not at all.
