Will you be booked and released if you are applicable for diversion after your case hearing?

Whether you are eligible for diversion has nothing to do with your needing bond out of jail. When you are arrested, you will either: (1) bond out of jail; or (2) wait to speak to the prosecutor about the possibility of entering a diversion program. If you have no attorney you may wait 7-10 days before discussing diversion.

You can refuse the alcosensor, which you did. When you get to court you get to explain how you blew a .06 coming from AA, which the jurors will suspect is a lie.
